New Points of Decree 175/2024/ND-CP Guiding the Vietnam Construction Law on Managing Construction Activities Compared to Decree 15/2021/ND-CP

One of the most important decrees for construction projects is the decree guiding the Construction Law on managing construction activities. From December 30, 2024, Decree 175/2024/ND-CP will take effect, introducing many new provisions compared to the previous Decree 15/2021/ND-CP.

Below are some important new points that construction businesses need to know, selected and summarized by Na&Partners:

  1. Building Information Modeling (BIM): Mandatory applied for certain projects, encouraged + Expanded application for state management (Article 8); Application of BIM in the qualification examination for construction professions (Clause 5, Article 89; Clause 5, Article 90).
  2. Appraisal Authority: 95% of administrative procedures from central agencies will be delegated to localities for appraisal, inspection of acceptance work, and 100% for issuing professional certificates and construction activity competency certificates; reducing about 10% of project documents requiring appraisal procedures at state agencies.
  3. Projects Only Requiring Economic-Technical Reports: Expanded scope of projects only requiring economic-technical reports: increasing total investment from under 15 billion to no more than 20 billion; increasing the total investment of construction investment projects mainly for procurement of goods, provision of services, equipment installation, or renovation projects that do not affect the structural safety of buildings with construction costs from no more than 5 billion to no more than 10 billion; adding Group C construction investment projects for maintenance, repair, and upkeep; dredging projects for public maritime channels, inland waterways.
  4. Validity Period of Construction Professional Certificates: 10 years for new issuance.
  5. Fields of Activity Not Requiring Professional Certificates for Individuals: Expanded and supplemented some professions, including: Design, preliminary design verification included in feasibility study reports for construction investment; design, design verification, supervision of construction completion works for road surface repairs; supervision of interior construction; projects only involving individual housing projects specified in Clause 7(b), Article 79 of the 2014 Construction Law; green parks; public lighting works; telecommunication signal transmission cable roads (Clause 3, Article 73).
